PSA VIDEO SUBMISSION RELEASE

By uploading my work to The Chainlink, I agree to the following

 SUBMISSION RELEASE

In exchange for allowing the artwork, photos, written works and/or other material that I have submitted to be considered for posting on websites owned or controlled by The Chainlink including without limitation the City of Chicago, Chicago Bicycle Film Festival and Active Transportation Alliance and/or inclusion in any other publications and/or websites (collectively, the “Media Outlets”), the entrant ("I," "me," "my," etc.) hereby grants a non-exclusive, royalty- free, worldwide, transferable, irrevocable and perpetual license to The Chainlink, the City of Chicago, Chicago Bicycle Film Festival, Active Transportation Alliance and others authorized by it, to use, copy, print, distribute, publicly display, broadcast and edit the Submission and my name, in whole or in part, with or without my name identification, in any and all media now known or hereinafter developed without time, territory, or other restrictions.

I understand that  does not guarantee that the Submission will be included in any Media Outlets, that thechainlink.org, the City of Chicago, Chicago Bicycle Film Festival, and Active Transportation Alliance shall have no liability to me if my Submission is not used, and that I waive all right to approve the final version of my Submission or attribution thereof as it appears in any Media Outlets.

I release The Chainlink, the City of Chicago, Chicago Bicycle Film Festival, Active Transportation Alliance and its affiliates, parent companies, subsidiaries and licensees, and each of their directors, shareholders, employees, officers, agents and representatives, from and against any costs, claims, damages, liabilities or any kind that I may have which may arise from The Chainlink, the City of Chicago, Chicago Bicycle Film Festival, Active Transportation Alliance’s use of my Submission as provided herein, including but not limited to claims relating to copyright infringement, right of publicity/privacy, blurring or optical distortion.

I represent and warrant that (i) I am of the age of majority in my state or province of residence (or, if not, that a parent or legal guardian will sign on my behalf); (ii) the Submission is my original work and has not been previously published; (iii) I (or my parent or legal guardian) have/has the legal authority to enter into this Release and to grant all rights herein without violating the legal or equitable rights of any third party, including without limitation rights of copyright, patent or trademark, right of privacy, and right of publicity; (iv) this Release does not in any way conflict with any existing commitments on my part; (v) if any other person’s name or likeness is used in the Submission, I have obtained permission from such person for the use thereof as contemplated in this Release; and (vi) no payments shall be due to me or any third party in conjunction with the use of the Submission or my name as provided herein.

I further agree to indemnify, defend and hold The Chainlink, the City of Chicago, Chicago Bicycle Film Festival, Active Transportation Alliance and its affiliates, parent companies, subsidiaries other entities, and each of their directors, shareholders, employees, officers, agents and representatives, harmless from any and all claims, actions, demands, damages, liabilities, costs and penalties, including reasonable attorney’s fees, arising directly or indirectly from any claim of infringement of third party rights from the use of the Submission by and on behalf of The Chainlink, the City of Chicago, Chicago Bicycle Film Festival, Active Transportation Alliance as provided herein. This Release shall be construed and interpreted in accordance with the internal laws of the State of Illinois, applicable to contracts made and performed entirely therein, without regard to conflicts of laws principles. I agree that jurisdiction and venue of all matters relating to this Release shall be vested exclusively in the Federal, state and local courts for The Chainlink, the City of Chicago, Chicago Bicycle Film Festival, Active Transportation Alliance.
