Theft is theft and should be dealt with to the fullest extent of the law! Unless you're a white collar CEO.

Now... how much of his tax dollars go to the school and did he pay for the tennis lessons at the school?

I think he is in the wrong for not asking permission.

A reasonable response would have been to ask him to stop.

Law officers are thoroughly trained and practiced in the use of "discretion" when determining what sorts of infractions are worthy of what level of attention/response.

I agree that it smells like there had to have been some sort of agenda/bias on the part of those who chose to treat it like a heinous crime.
