If ever I'm arrested, it will be for assaulting a pedestrian in the Dearborn PBL

THAT IS ALL.

(just kidding.  Assaulting a driver in the PBL is another tempting possibility)

Is a car's windshield considered an individual now?

Yeah, I don't know...  I was on my way to work and, really who wants to get arrested?

Just some story background- I was riding North on State (I didn't have a stop sign) and this car rolls through a stop sign (from side street) and starts to turn into me.  I think I rang my bell, he stopped suddenly and I made some spittle fly far enough to hit his windshield as I passed his front bumper.  A couple blocks later- I heard a cop's siren, looked over my shoulder and saw him approaching.  I pulled over and he did too, followed by the car I spit on.  The cop saw the infraction and decided to pull me over.

Okay, spitting may be disgusting. Provoking or insulting - sure. But how does that constitute PHYSICAL contact when it's touching the windshield, not the person? You lost me on that one.

(720 ILCS 5/12-3) (from Ch. 38, par. 12-3)
    Sec. 12-3. Battery.
    (a) A person commits battery if he or she knowingly without legal justification by any means (1) causes bodily harm to an individual or (2) makes physical contact of an insulting or provoking nature with an individual.

Seems like a stretch to me.

IL legal definition of assault would be; threatening words like "I'm going to kick ur a$$". An aggravated assault would be threatening a CTA driver, elderly person, ambulance drivers ect... A battery is a bit worse and is when actually contact is made. For example, a punch to the nose. An aggravated battery is if you used a weapon when you hit the victim. Spitting is a very nasty battery. The offender could have a disease and then the charges get worse.

Hah. I spit into a guys window when he opened it to call me a "faggot". Pretty sure I nailed him good because he started screaming more obscenities afterwards. Prior to this, he was honking and aggressively following me. Needless to say, I got my ass out of there as fast as possible.

Way to escalate a situation.

And then run away from it.
