It seems as if the Active Transportation Alliance has stopped posting updates.

Jason Jenkins emailed that he was unable to attend the last hearing, which was 10/2, and asked that anyone who did attend to fill him in, from what I recall.  

From 9/23:

"Just a quick update from Monday’s hearing. The presiding Judge, Judge Hooks was out and a substitute judge presided over the hearing which was very short and simply set a new date to hear a new motion entered by the defense to dismiss the search warrant. The next date was set for 10/02/15, which is a week from Friday. If you are able to attend please let me know."

A hearing has been scheduled for 10/15/2015 at 10:00 AM. This will take place in Circuit Court 127, located at the following address: 2600 South California Ave, Chicago, IL .

This is a very short transcript of the hearing on September 21st.  It was a temporary judge substituting for Judge Hooks and has nothing substantial.

This hearing was followed by a hearing on October 2nd (which I haven't gotten a transcript for yet) and this was followed by the most recent hearing on Thursday, October 15th.   I have no idea of if and when I'll get notified that either of the transcripts will be made available.  Feel free to call the Court Reporters Office and request a transcript.  (773) 674-6065

We don't seem to be getting any information from anyone attending the hearings so this is the only way I know of we can get complete and accurate reports.

But why isn't their any reporting of what's happening at the actual court hearing? Why no reporting on this? The silence is deafening.

THE SENTENCING IN THE HECTOR AVALOS CASE IS NOVEMBER 17th. Details below. 
Robert Vais plead guilty recently to Aggravated DUI in the death of Hector Avalos. It is a Class 2 Felony and carries a sentence of 3-14 years with only a possibility of probation and fines of up to $25,000.00. 
At the hearing the Prosecutor, Assistant State's Attorney Shawn Concannon noted that the breathalyzer taken at 2:06 a.m. (over two hours after the fatal crash) was .118. However, THE BLOOD DRAW TAKEN AT ST. ANTHONY'S AFTER THE CRASH CAME BACK AT .152 ACCORDING TO THE TOXICOLOGIST. That is nearly double the legal limit of .08. In other words, Vais was at a high level of intoxication at the time of the crash than his breathalyzer over two hours after the crash. Two hours later he was still at .118. 
At the hearing Vais acknowledge on the record that he was pleading guilty of his own free will and understood that it was a "blind plea" meaning there was no guarantee as to what his sentence would be. Judge Ford will determine his sentence. 
Sentencing is scheduled for November 17, 2015 at 11:00 a.m. in Courtroom 702 (Judge Nicholas Ford) at 26th & California.
