Hector's mom just called to say that a (first?) court date is tomorrow (Friday 2014.01.03) at 26th and California, at noon, room 1200.

She encourages concerned cyclists to come and introduce yourself to her and she wants to take everyone to lunch.  I think she said it's going to be paperwork, and maybe doesn't expect to take long.  She also spoke of having something printed (handouts? signs?), and of TV news attention.  I told her I'd ChainLink post it.

Hope I got some facts straight.  I'm maybe not the best liaison on such things, but we'd had a long conversation at Junior's after last Critical Mass and exchanged numbers.  She seems very fond of cyclists, and spoke of riding with us going forward,

She sounded like she could use some kindness and company.

Bonded out December 8th.

Yea a guy drives drunk and the cyclist holds some of the blame.

The next hearing related to Hector’s crash is a week from today, on Tuesday, May 20th, at 9:30 a.m. in COURTROOM 702.

If you are planning or able to attend please let me know. Remember that cell phones and other electronic devices are not allowed so leave them at home or securely stowed out of sight in your car if you drive to the hearing. Also give yourself a good 30 minutes to get through security.

Judge Ford, the Presiding Judge of the case against Defendant Robert Vais, is on trial and the hearing on Tuesday, May 20th, will start around 9:15 a.m. This is earlier than the typical schedule due to the trial so if you are coming please plan accordingly. Thank you.

Hello all, I wanted to pass on this info I received from the Avalos family atty. Please note the bolded copy.

"The next court date in the criminal case against Robert Vais, the motorist who was charged with allegedly driving under the influence and allegedly causing the death of Hector Avalos, is:

SEPTEMBER 24, 2014
AT 9:30 A.M.
IN COURTROOM 702
JUDGE NICHOLAS FORD

Other than a possible trial, this will be perhaps the single most important date in this criminal case. The defendant, Robert Vais's, attorneys have filed a Motion to Quash Arrest. The Motion argues that the police officers responding to the scene did not have probable cause to arrest Robert Vais. There will be a hearing where the responding police officers will testify regarding their observations and other factors that led to their determination that there was probable cause to make the arrest. If the judge grants the motion, the case will be dismissed or "thrown out of court" as is the common parlance. If the judge denies the motion, the case continues towards a trial.

This is a very important date where a strong showing of support on behalf of Hector Avalos and his family could be helpful to the family during this difficult time. Please note that while the court time is "officially" 9:30 that Judge Ford routinely doesn't come on the bench until 10:00 a.m. and the case may not be called until after that. There is no way for sure of knowing what time the case will be heard and this is as specific of information as I can provide.


Even if you have not been trained as a Courtroom Advocate, it would still be worthwhile to show up.
